1. Acceptance of These Terms

By using www.kmlighthouse.com (the "Site") or submitting an inquiry, you agree to these Terms and Conditions. If you do not agree, please do not use the Site.

The Site is operated by K&M Lighthouse Development Group LLC ("K&M Lighthouse," "we," "us," or "our"). These Terms apply to all visitors, sellers, buyers, builders, and developers who use the Site.

2. Our Services

K&M Lighthouse is a veteran-owned, family-operated real estate business. We connect landowners who want to sell with builders and developers looking for off-market land.

  • For sellers: we offer free, no-obligation property evaluations and may make offers to purchase land directly or through an affiliate.

  • For buyers: we source off-market parcels, such as infill lots, subdivisions, and commercial properties, based on criteria you provide.

We act as a principal buyer, seller, or assignor of contracts. We are not a licensed real estate broker or agent, and we do not represent you in any transaction unless agreed in a separate written agreement. We may profit from buying, selling, or assigning interests in property. 

Nothing on the Site is legal, tax, financial, or appraisal advice. You should consult your own attorney, accountant, or other professional before entering any real estate transaction.

3. Inquiries, Evaluations, and Offers

  • No obligation. Submitting a Seller Inquiry or Buyer Inquiry form does not create any contract, commitment, or obligation for you or for us.

  • Evaluations are estimates. Any property evaluation, price range, or opinion of value we share is informal and non-binding. It is not an appraisal.

  • No binding offer until signed. An offer to buy or sell property is binding only when set out in a written purchase agreement signed by both parties. That agreement will control over these Terms.

  • Availability. Property listings or opportunities we describe may change, sell, or be withdrawn at any time without notice.

  • Response times. We aim to respond to inquiries within 24 hours, but response times are not guaranteed.

  • Accurate information. You agree that information you submit is accurate and that you have the right to share it. If you submit information about a property, you represent that you own it or are authorized to act for the owner.

4. Use of the Site

You agree not to:

  • Use the Site for any unlawful, fraudulent, or misleading purpose.

  • Submit false information or impersonate another person.

  • Send spam, malware, or automated submissions through our forms.

  • Scrape, copy, or harvest content or data from the Site without our written permission.

  • Interfere with the Site's security or operation.

We may refuse service, ignore inquiries, or block access to anyone who violates these Terms.

5. Intellectual Property

All content on the Site, including text, logos, images, and design, is owned by K&M Lighthouse or its licensors and is protected by copyright and trademark laws. You may view the Site for personal, non-commercial use. You may not copy, reproduce, or distribute its content without our prior written consent.

6. Third-Party Links

The Site may link to third-party websites or services. We do not control and are not responsible for their content, policies, or practices. Your use of them is at your own risk.

7. Disclaimer of Warranties

The Site and all information on it are provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that information about any property, including size, zoning, access, utilities, title, or value, is accurate, complete, or current. You are responsible for your own due diligence before buying or selling property.

8. Limitation of Liability

To the fullest extent permitted by law, K&M Lighthouse and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost opportunities, arising from your use of the Site or reliance on its content. Our total liability for any claim related to the Site will not exceed $100.

This limitation does not apply to obligations under a signed purchase agreement, which is governed by its own terms.

9. Indemnification

You agree to indemnify and hold harmless K&M Lighthouse and its owners, employees, and partners from any claims, losses, or expenses, including reasonable attorneys' fees, arising from your violation of these Terms or from information you submit through the Site.

10. Privacy and Communications

Your use of the Site is also governed by our Privacy Policy. By submitting an inquiry with your phone number or email, you agree that we may contact you by phone, text message, or email about your inquiry and related real estate opportunities. Message and data rates may apply. You can opt out of texts by replying STOP, or of emails by using the unsubscribe link or contacting us.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be resolved in the state or federal courts located in Morris County, New Jersey, and you consent to their jurisdiction.

12. Changes to These Terms

We may update these Terms at any time by posting the revised version on this page with a new "Last updated" date. Your continued use of the Site after changes are posted means you accept the updated Terms.

13. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it. These Terms are the entire agreement between you and us regarding use of the Site.
